Is auto insurance required in California?
Yes. California law requires every driver and every registered vehicle to carry proof of financial responsibility, which for almost everyone means auto liability insurance. You have to show proof when you register your vehicle with the DMV, if you’re pulled over, and after an accident.
Since January 1, 2025, California’s minimum liability limits are:
- $30,000 for injury or death to one person
- $60,000 for injury or death to more than one person
- $15,000 for property damage
You must also keep your coverage continuous. Insurers report policy information to the DMV, and a lapse can lead to your registration being suspended.
What are the penalties for driving without insurance?
- Fines: a first offense carries a base fine of $100 to $200, and a second offense within three years $200 to $500. With California’s added penalty assessments, the total can be several times the base fine.
- Impound: your vehicle may be impounded, adding towing and storage costs.
- License suspension after an accident: if you’re in a crash that causes injury or more than $1,000 in damage and you don’t have insurance, your license can be suspended for up to four years. You’ll typically need an SR-22 filing to get it back.
- “No pay, no play”: under Proposition 213, uninsured drivers generally can’t recover pain and suffering damages, even when the other driver caused the accident.
- Personal liability: if you cause an accident, you’re personally responsible for the other people’s medical bills and vehicle damage.
Not having auto insurance can cost you far more than having it!
